We may use and disclose deidentified data as permitted by the laws and contracts that apply to us.

Our commitment regarding deidentified data

We take reasonable measures to ensure that the deidentified data that we collect or create cannot be associated with you or your household. When we collect or create deidentified data we commit to maintain and use the information in deidentified form and will not attempt to reidentify the information unless we are permitted to do so by applicable law.

Optional sign-in service

The Platform may give you the option to sign in or create an account using your credentials from a third-party service such as Apple, Google, or another identity provider (each an “Identity Provider”). When you choose this option, Pyx Health and the Identity Provider exchange the information necessary to authenticate your identity and enable account creation or access. This may include your name, verified email address, a unique identifier, and technical information (such as tokens or device identifiers) used to verify your credentials. Your use of any third-party sign-in service is governed by that Identity Provider’s own privacy policy. You may revoke our access or unlink your Platform account at any time by adjusting your settings within that Identity Provider’s account management tools, for example, through your Apple ID or Google Account settings.

Social media

You may decide to engage with us outside of the Platform on social media sites like Facebook, LinkedIn or X (formerly Twitter). If you engage with us on social media, you may “opt in” to sharing your social media content with us. Be aware that the content you submit to social media sites (uploads, posts, comments, shares, “likes” and any messages or tweets) will be publicly visible. To manage the social media notifications you receive or to adjust your privacy settings on your social media accounts, please access the profile section of your social media accounts and follow the directions there.

Electronic Communications

We may need to contact you about the Platform, your activity on the Platform and our services. Additionally, if you (or your health care provider or health plan) have chosen to provide the Platform with information about your doctor’s appointments, medications, prescription refills, and other matters related to your care, you may receive push notifications or text messages, reminding you of these events or asking you to open your Platform for details about these events. We may also notify you of important information and events that may affect your health or care, such as a natural emergency disaster in your area. By giving us your contact information, you have agreed that Pyx Health, as well as our affiliates, business partners, service providers and contractors, may contact you for these purposes. These communications may be done by automated dialing equipment and/or artificial or prerecorded messages. You may receive multiple messages each day. We do not charge for our short message service (SMS); however, regular message and data rates may apply from your mobile carrier. We are not responsible for any data transmission fees. You can opt out at any time by replying “STOP” to a text message or by contacting us at [email protected]. This opt-out process does not apply to live phone calls or emails, which may continue in case we need to reach you.

You must follow the requirements of this Platform Privacy Policy and our Platform Terms of Use when contacting us via email. Please note that the information you provide to us through email or text messages such as a device’s SMS, or other electronic means, may not be secure (i.e., is not encrypted). There are risks associated with unsecure communications that you should consider. These risks include (without limitation) that an unauthorized person may get access to these communications. By engaging us in unsecure communications, you agree to accept these risks and consent to receive unsecure communications in response from us. If you engage us in unsecure electronic communications, please do not include any Sensitive Information in your communication.

Automated technologies

As you navigate through and interact with our Platform, we may use automated technologies to collect information about your Internet connection, the equipment you use to access our Platform, and information about how you use the Platform (called “Usage Data”). This Usage Data helps us to improve the Platform and deliver a better and more personalized service, including by enabling us to do things, such as:

  • Estimate our audience size and usage patterns;
  • Store information about your preferences, allowing us to customize our Platform according to your individual interests; and
  • Address technical and/or security issues, including verifying system and server integrity.

The types of automated technologies that we might use include:

  • Cookies. When you visit our Platform, we may store or recognize some information on your device in the form of a “cookie” or similar technology. A cookie is a text file that is placed on your device by a web page server, using functions provided by your web browser.
  • Web Beacons (or Pixels). Parts of our Platform may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, single-pixel gifs, or pixels). Web beacons generally work in conjunction with cookies to register when a particular device visits a particular page.

Some of these automated technologies may be required for us to provide a specific feature or service through the Platform. For example, they allow us to display the Platform in the proper format or language or to authenticate registrations and transactions. Other cookies may provide a convenience feature to save you time. Most web browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Platform.

If we use automated technologies that are not necessary to our operation of the Platform, we may give you the opportunity to opt-out of their use.

Web browsers and do not track (DNT) signals

Some website browsers have a “do not track” (DNT) feature that lets you tell other websites that you do not want to have your online activities tracked. No uniform technology standard for recognizing and implementing DNT signals has been finalized. We do not currently respond to a browser’s DNT signal. We are not aware of, and do not knowingly allow, such third parties to track your activity over time on the Platform. However, we may share information about your Platform usage with the client who has authorized your use of the Platform and our service providers, contractors, affiliates, business partners, and other relevant third parties as described in this Privacy Policy.

Artificial intelligence

We may use artificial intelligence (AI), machine learning engines or systems, neural networks, or substantively similar technologies (collectively “AI Capabilities”) in connection with our Platform and related services. For more information about the AI Capabilities that Pyx Health may use please read our Platform Terms of Use. Your personal information may be used and disclosed in connection with these AI Capabilities for the purposes described in this Privacy Policy, including (but not limited to) managing and improving the quality of the Platform and services that we provide and for other internal business purposes. We may also use and disclose deidentified data derived from your personal information in connection with new products and services, including (but not limited to) training new AI Capabilities. By using our Platform and related services, you acknowledge and agree that your personal information and deidentified data derived from your personal information may be processed by these AI Capabilities in accordance with this Privacy Policy.

Your information and HIPAA

Some of the information we collect about you is protected by HIPAA—the Health Insurance Portability and Accountability Act and its implementing regulations. We may be providing this Platform to you on behalf of a health plan or health care provider (or a third party that works on behalf of, or provides services to, a health plan or health care provider, such as an accountable care organization). The health plan, health care provider or people who work with them may share your personal information and other information with others if they are permitted to do so under the laws that apply to them. We cannot control how your health plan, health care provider or other people who work with them use or share your personal information or other information. Please read your health plan’s and your health care provider’s HIPAA Notice of Privacy Practices for more information about how your protected health information can be used and disclosed under HIPAA. If you have any questions or concerns about how your health plan or health care provider is managing your information, please contact them directly.

We may also not be permitted by your health plan or health care provider to provide you with all the services or in-App functionality described in this Privacy Policy or Platform Terms of Use. That is because under HIPAA we may be a “business associate” of your health plan or health care provider and thus can only use your personal information as permitted by your health plan or health care provider.

Security of your personal information

Pyx Health takes reasonable steps to keep your personal information secure and to protect against the loss, misuse, or alteration of your personal information on the Platform. Although Pyx Health has these security measures on the Platform in place, it cannot guarantee your privacy.

Please be aware that email and text messaging on your device’s SMS (or other text messaging applications) are not secure (not encrypted) methods of communication. There is the risk that email messages and text messaging on your device’s SMS (or other text messaging applications) could be intercepted or read by other people. If you email us, we will respond to you by email and that email communication will not be secure (not encrypted). Please do not use e-mail to communicate with us about confidential matters. By using the Platform, you are agreeing to accept these risks and consent to receive unsecure communications.

Using the Platform outside of the United States

Pyx Health intends the Platform to be used by residents of the United States in the United States. This Platform is not intended for use by individuals who are not located in the United States. If you are visiting our website or using the Platform from outside the United States, please be aware that your personal information and other information will be transferred to, stored, and processed in the United States, where our servers are located and our central database is operated. The data protection and other laws of the United States might not be as comprehensive as those in your country. By using our website or Platform, you understand that your personal information and other information may be transferred to our facilities in the United States and those third parties with whom we share it as described in this Privacy Policy.

The Platform may contain links to websites that are owned or operated by third parties (for example, www.211.org). If you click on a third party link, you will go to that third party website. We do not have control over third party websites and those websites do not operate under this Privacy Policy. You should review the privacy policies of third party websites before using them.

Children’s Privacy

Our Platform is not directed at and not intended to be used by any children under the age of 13. You must not use the Platform if you are a child under the age of 13. We do not knowingly collect or solicit any information from children under the age of 13 or knowingly allow such children to use the Platform. A parent or guardian is required to provide consent for Pyx Health to collect, use, or share personal information from a child under the age of 13. Your health plan or health care provider may require you to be at least 18 years of age or older in order to use the Platform.

Children under the age of 18 may request that any information posted to the Platform be removed by contacting us at: [email protected]. Removing information posted to the Platform does not guarantee complete or comprehensive removal of the content or information posted.

Correction of information; cancellation; misuse of information

The Website may contain links to third-party owned or operated websites (collectively, “Linked Sites”). This Website Privacy Policy and the practices that we follow under this Website Privacy Policy do not apply to Linked Sites. We are not responsible for the content, accuracy, or opinions expressed on any Linked Site or for the privacy practices or security standards used by third parties on such Linked Sites. These Linked Sites have separate privacy and data collection practices, and we have no responsibility or liability relating to them. Accordingly, if you use Linked Sites through our Website, or share information about your experience on our Website with others, these Linked Sites may be able to collect information about you, including information about your activity on our Website. You understand and agree that by clicking on a link to a Linked Site or using a Linked Site as described above, this Website Privacy Policy, as stated on the Website, is no longer in effect because you have either left our Website or used a Linked Site to interact with our Website.

Terms of Use

Your use of the Platform is also subject to Pyx Health’s Platform Terms of Use. Any disputes related to this Privacy Policy will be governed by the applicable provisions of the Platform Terms of Use, which are incorporated into this Privacy Policy by reference.
